Warranty conditions

1. Scope of application

These conditions govern the contractual/commercial warranty provided by uSolar S.r.l. for photovoltaic systems, storage systems and related accessories supplied and installed by uSolar.

The guarantees of the manufacturers of the individual components remain autonomous and separate from this uSolar warranty and are governed exclusively by the relevant official documents.

2. Distinction between consumer and professional customers

For the purposes of these conditions:

– “Consumer Customer” means the natural person who acts for purposes unrelated to their entrepreneurial, commercial, artisanal or professional activity;

– “Professional Customer” means anyone who acts in the exercise of their entrepreneurial, commercial, craft or professional activity.

For Consumer Customers, the unchangeable rights provided by law remain in effect and unaffected.

The clauses of these conditions that provide for exit costs, relocation, labor, disassembly, reassembly or other on-site activities in the event of a defect in the product itself apply exclusively to Professional Customers, unless otherwise agreed in writing.

3. Duration and commencement of the uSolar warranty

uSolar provides a 2-year warranty on the proper installation of the system.

The warranty begins on the date of the test report and commissioning of the system, or, in the absence thereof, on the date of completion of the works communicated by uSolar to the customer.

Any repairs or replacements performed by uSolar under warranty do not extend the overall duration of the warranty for the entire system, unless otherwise agreed in writing and without prejudice to the unwaivable rights provided by law.

4. Subject of the uSolar warranty

The uSolar warranty covers exclusively defects and flaws attributable to uSolar and relating to activities performed by uSolar or by third parties commissioned by it, with particular reference to:

technical inspection;

  • executive design;
  • installation and assembly;
  • fixing and assembling;
  • wiring and connections;
  • configuration and initial programming;
  • testing and commissioning.

This warranty covers, by way of example and not exhaustive, defects resulting from:

  • incorrect assembly or fixing of the components;
  • incorrect wiring or connection of the equipment;
  • incorrect configuration or initial programming attributable to uSolar;
  • testing or commissioning errors attributable to uSolar;
  • other vices directly attributable to activities performed by uSolar.

This warranty does not constitute a guarantee of producibility, energy yield, self-consumption, economic savings, return on investment time, obtaining incentives, contributions, deductions or tax benefits, unless otherwise specified in a written agreement expressly signed by uSolar.

5. Exclusions from the warranty

The following are excluded from the warranty, by way of example and not exhaustive:

a) the failures or malfunctions are solely due to a defect originating in the manufacturing process or to another intrinsic cause of the product or component, not attributable, even in part, to uSolar;

b) normal wear and tear;

c) the regular and periodic maintenance interventions;

d) the improper or non-compliant use of the system or of the individual components;

e) failure to comply with technical instructions or user and maintenance manuals;

f) the failure to maintain it properly, insufficient maintenance or incorrect maintenance;

g) the modifications, alterations or repairs performed by the customer or by third parties without the prior written authorization of uSolar;

h) damage caused by accidents, impacts, fires, floods, lightning, overvoltages, exceptional weather events, vandalism, theft, animals, rodents or otherwise by external causes not attributable to uSolar;

i) Defects or criticalities resulting from pre-existing or emerging conditions of the property, the coverage, the electrical system, the data line, the internet connection, the electrical cabinet or other works and systems not carried out by uSolar;

j) delays, denials, suspensions or outages attributable to the network operator, the GSE, the connectivity provider or other third parties;

k) everything that is not directly related to the activities performed by uSolar.

6. Mode of reporting the defect

The customer must report the defect in writing to uSolar, without delay and in any case within the applicable legal or contractual deadlines.

The report must be sent to the email assistenza@usolar.it or through the contact section of the uSolar website.

The report must contain, as far as available:

  • name or company name of the customer;
  • address of the installation site;
  • number of offer, order, contract or invoice;
  • date of testing or commissioning;
  • Detailed description of the problem;
  • any alarm codes;
  • photographs, videos, screenshots, serial numbers, logs and any other information useful for diagnosis.

uSolar is able to perform a preliminary remote diagnosis before scheduling any on-site visit.

To obtain a timely response and track the ticket and verify the progress of the case, reports of malfunctions made using means other than those described in point 6 will not be accepted.

7. Obligations of the customer for the intervention

For the purposes of any intervention, the customer must:

  • ensure free and safe access to places;
  • make available, where necessary, electricity, data connection and any other technical utility reasonably necessary for the diagnosis or intervention;
  • indicate a contact person who is present or available;
  • refrain from autonomous interventions or assignments to third parties without the prior written authorization of uSolar, except in cases of proven emergencies related to the safety of persons or property.

In the event of interventions carried out by the customer or by third parties without the prior written authorization of uSolar, the warranty shall be limited to the parts, components or problems affected by such interventions.

8. Interventions covered by the guarantee

If the defect is covered by this warranty and attributable to uSolar, uSolar will, within a reasonable period and in accordance with the safety conditions of the site, ensure the availability of the materials and the accessibility of the system to carry out the repair, replacement or other technical intervention necessary to remove the defect.

For Consumer Customers, the unchangeable rights provided by law remain unchanged.

9. Defect of the product alone: specific discipline for Professional Customers

If the malfunction is solely due to a defect or flaw inherent in the product or component and is not attributable, even in part, to any activities of inspection, design, installation, assembly, fixing, assembly, wiring, configuration, programming, testing, commissioning, maintenance or other activities attributable to uSolar, any onsite assistance requested by the Professional Client constitutes a paid service.

In such cases, the Professional Client remains responsible, unless otherwise agreed in writing:

  • right of call;
  • on-site diagnosis;
  • exit;
  • trip;
  • manual labor;
  • car rental;
  • accesses in quota;
  • temporary works;
  • security charges;
  • disassembly and installation;
  • reinstallation and reassembly;
  • reconnection and reconfiguration;
  • testing and commissioning;
  • packaging, shipping, handling returns and any other accessory costs necessary for the intervention.

The mere warranty coverage of the component by the relevant manufacturer or supplier does not include, in B2B relationships, free on-site intervention by uSolar, unless otherwise agreed in writing.

If, following a technical verification, the defect is found to be attributable to uSolar, no costs will be charged to the Professional Customer for the activities covered by this warranty, and any amounts already paid will be refunded or returned.

This special provision applies exclusively to Professional Clients and in no way limits the unchangeable rights of Consumer Clients.

10. Uncovered interventions and paid activities

When the request for assistance proves unfounded, the warranty has expired, the defect is not covered, the failure is due to excluded causes, or the intervention is requested by the Professional Customer for a defect in the product alone, uSolar may issue a quote or apply its current service list.

Unless there are urgent cases related to security, paid activities will be carried out after the customer has accepted the corresponding quote.

11. Production, estimates and forecast data

Any estimates of yield, self-consumption, performance, savings, payback or other predictive data included in offers, simulations, reports, commercial presentations or other documents have statistical and predictive value and do not constitute a guarantee of results, unless otherwise expressly agreed in writing signed by uSolar.

12. Final clauses

In any case, the unchangeable rights provided for by law remain in effect.

No clause of these conditions excludes or limits uSolar’s liability in cases where such exclusion or limitation is not permitted by law.

To the extent not provided for by these conditions, the special conditions contained in the offer, the order, the order confirmation or the contract apply, and, as a last resort, Italian law.
